Terms & Conditions

At Spartic Coatings, we are committed to providing durable, attractive, and long-lasting floor coatings that enhance and protect your space. Our team uses premium materials, proven installation methods, and professional care to deliver results you can rely on.

This Agreement outlines the scope of work, warranty coverage, and the mutual responsibilities that help ensure a smooth project and a quality finish. While it contains important legal terms, our focus is on your satisfaction and creating a floor you will enjoy for years to come.

1. Warranty Terms

(a) Warranty

Spartic Coatings' coating system is warranted against peeling, chipping, delamination, and fading caused by ultraviolet (UV) exposure for the lifetime of the floor, subject to the exclusions, limitations, and conditions set forth herein.

Labor (workmanship) is warranted for one (1) year from the date of substantial completion under normal use conditions.

Material defects as defined above shall be covered for the lifetime of the floor at no charge for replacement materials, provided such defect is determined by Spartic Coatings to be covered under this warranty.

WARRANTY COVERAGE IS EXPRESSLY CONDITIONED UPON THE CUSTOMER'S COMPLIANCE WITH THE SPARTIC COATINGS MAINTENANCE GUIDE DELIVERED UPON COMPLETION OF INSTALLATION.

THIS WARRANTY SHALL BE VOID IF ANY ALTERATION, REPAIR, OR RECOATING OF THE COATING SYSTEM IS PERFORMED BY ANY PARTY OTHER THAN SPARTIC COATINGS OR ITS AUTHORIZED REPRESENTATIVES.

ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY LAW.

(b) Warranty Exclusions

THIS WARRANTY DOES NOT APPLY TO, AND SPARTIC COATINGS SHALL HAVE NO LIABILITY FOR, ANY FAILURE, DEFECT, DAMAGE, OR CONDITION ARISING OUT OF OR RELATING TO:

  • Application to non-concrete surfaces, including wood, steps, trim, joints, or tiles.
  • Substrate failure, including cracks, sinking, shifting, heaving, popping, settling, or ground movement.
  • Aggregate pops caused by moisture pushing aggregate out of the concrete.
  • Moisture-related conditions, including vapor transmission, water intrusion, sweating, condensation, or hydrostatic pressure — REGARDLESS OF WHETHER MOISTURE MITIGATION WAS ATTEMPTED.
  • THE SPARTIC COATINGS SYSTEM IS NOT A WATERPROOFING SOLUTION, AND NO GUARANTEE IS MADE AGAINST WATER LEAKAGE TO AREAS BELOW PRECAST CONCRETE OR THE COATED SURFACE.
  • Damage caused by chemicals, petroleum-based products, corrosive substances, rust, battery acid, or similar agents.
  • Loss or damage from Acts of God or other events beyond reasonable control.
  • Abnormal wear and tear inconsistent with normal, intended, or reasonable use.
  • Pre-existing damage or defects in the concrete or surrounding structures.
  • Incidental or secondary damage to adjacent surfaces or property, even where reasonable precautions have been taken.

ALL CLAIMS UNDER THIS WARRANTY MUST BE SUBMITTED IN WRITING WITHIN THIRTY (30) DAYS OF THE CUSTOMER'S DISCOVERY OF THE ALLEGED DEFECT, AND MUST BE SUBMITTED USING THE WARRANTY CLAIM FORM PROVIDED BY SPARTIC COATINGS AFTER INSTALLATION.

Claims must include photographic evidence of the condition and a written description of the issue.

THE CUSTOMER SHALL GRANT SPARTIC COATINGS REASONABLE ACCESS TO THE PROPERTY FOR INSPECTION WITHIN SEVEN (7) BUSINESS DAYS OF SUCH REQUEST.

If the claim is determined to be covered under this warranty, Spartic Coatings will supply replacement materials at no cost. Labor charges may apply after the first year.

2. Project Scope & Limitations

(a) Surface Preparation & Repairs

All surfaces shall be prepared in accordance with industry standards for polyaspartic coatings. The coating system is not intended to level or grade the surface.

Crack repairs are performed using proprietary, industry-standard methods designed to be preventative; however, THERE IS NO GUARANTEE THAT CRACKS WILL NOT REAPPEAR.

Repairs or touch-ups may vary in appearance from surrounding areas due to batch differences, wear, or fading.

(b) Moisture Treatment

Spartic Coatings shall test each floor for moisture prior to or during installation. If excessive moisture is detected, Spartic Coatings may need to apply a moisture mitigation system to reduce the risk of moisture-related issues. SUCH APPLICATION MAY RESULT IN AN ADDITIONAL COST TO THE CUSTOMER.

SUCH TREATMENTS REDUCE, BUT DO NOT ELIMINATE, THE RISK OF MOISTURE-RELATED ISSUES. ANY SUCH ISSUES REMAIN EXCLUDED FROM WARRANTY COVERAGE.

(c) Vertical Surfaces

Coating applied to vertical surfaces may differ in color, texture, or gloss from horizontal surfaces, and may present a rough or sharp texture.

(d) Surface Imperfections

The coating system is not intended to level or grade the substrate. Substrate imperfections, including but not limited to high or low spots, trowel marks, and variations in texture or finish, may remain visible after installation.

(e) Standing Water / Condensation / Rust Stains

This Agreement does not cover damage, discoloration, or staining caused by standing water, sweating/condensation, or rust transfer from metal objects or structures.

3. Customer Selections & Conditions

(a) Colors

The Customer shall be solely responsible for selecting colors prior to commencement of work. Color selections must be finalized prior to installation. Changes not communicated before crew arrival may result in project delays and additional charges. Spartic Coatings shall not be liable for variations in color or finish due to lighting or substrate differences.

(b) Scheduling & Completion

Any schedule provided is an estimate only and is not a guarantee of start date, completion date, or duration.

Spartic Coatings reserves the right to reschedule work without penalty in the event of unsuitable conditions, including but not limited to inclement weather, material delays, or site readiness issues.

(c) Daily / Unknown Conditions

If unforeseen site conditions are discovered before or during installation, including but not limited to substrate defects, structural deficiencies, hazardous materials, or inaccuracies in quoted measurements or pricing, Spartic Coatings reserves the right to suspend or terminate work. In such cases, the Customer shall be entitled to a refund for unperformed work, less the cost of materials delivered or services rendered to date.

4. Customer Responsibilities

(a) Customer Responsibilities

The Customer shall:

  • Provide clear and unobstructed access to the work area, including electricity and water.
  • Remove all personal property, vehicles, and obstructions before work begins.
  • Ensure the site is dry, hazard-free, and suitable for coating application.
  • Protect items in adjacent areas from dust, debris, and incidental contact.
  • Approve in writing any change orders or additional work before commencement.

IF ITEMS REMAIN IN THE WORK AREA UPON ARRIVAL, SPARTIC COATINGS MAY REMOVE THEM AT $100/HOUR IN ADDITION TO ANY RESCHEDULING OR DELAY CHARGES.

(b) Dust Protection

While Spartic Coatings will take reasonable measures to limit dust, including use of vacuum systems, coating preparation and installation is an inherently dusty process. The Customer is advised to remove or adequately protect all items in or near the work area prior to commencement of work.

(c) Media for Training & Advertising

The Customer grants Spartic Coatings the right to photograph, film, and otherwise record the work area before, during, and after installation for the purposes of training, quality assurance, and advertising. Such media may be used in print, online, and social media marketing materials without further consent or compensation, provided that no personally identifying information about the Customer is disclosed without prior written approval. We respect and value your privacy. If you prefer not to have your service recorded, please let us know in advance.

5. Safety, Use & Liability

(a) Safety and Slip Resistance

Slip-resistant additives are available at the time of installation. Any surface can become slippery when wet, icy, or contaminated.

IN NO EVENT SHALL SPARTIC COATINGS BE LIABLE FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, OR OTHER LOSSES ARISING FROM SLIPS, TRIPS, OR FALLS UNDER ANY CIRCUMSTANCES.

The Customer accepts full responsibility for warning and protecting all users of the coated area.

(b) Return to Use

  • 12 hours after completion – light foot traffic permitted.
  • 24 hours after completion – light items may be returned.
  • 48 hours after completion – full use permitted, including vehicle traffic and heavy loads.

USE OF THE COATING SYSTEM PRIOR TO THESE TIMEFRAMES VOIDS WARRANTY COVERAGE FOR ANY RESULTING DAMAGE.

(c) Events Beyond Control

Spartic Coatings shall not be liable for delays, damages, or failure to perform service caused by events beyond its reasonable control, including but not limited to weather, labor disputes, material shortages, accidents, equipment failure, or Acts of God.

6. Financial Terms

(a) Cancellation & Deposits

THE CUSTOMER MAY CANCEL THIS AGREEMENT WITHIN SEVEN (7) BUSINESS DAYS OF SIGNING FOR A FULL REFUND.

After this period, deposits are non-refundable and may be applied toward administrative, material, or labor costs already incurred.

If materials have been delivered or work has commenced, the Customer shall pay for all goods received and work performed to date.

(b) Payment Terms & Lien Rights

Payment is due in accordance with the terms stated in the signed estimate or invoice. Spartic Coatings reserves the right to record a mechanic's lien or similar security interest as permitted under applicable law for unpaid amounts.

(c) Interest on Overdue Accounts

Any unpaid balance shall accrue interest at a rate of two percent (2%) per month (twenty-four percent [24%] per annum) until paid in full.

7. Legal Terms

(a) Dispute Resolution

All disputes arising out of or relating to this Agreement shall first be submitted to mediation.

If mediation is unsuccessful, such disputes shall be resolved by binding arbitration in Pennsylvania in accordance with the rules of the American Arbitration Association (AAA) or another mutually agreed arbitration provider.

(b) Legal Provisions

  • Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania.
  • Entire Agreement: This Agreement, together with any signed estimate or invoice, constitutes the entire agreement between the parties.
  • Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

(c) Waiver

No waiver of any provision of this Agreement shall be valid unless in writing and signed by an authorized representative of Spartic Coatings. The failure of Spartic Coatings to enforce any provision shall not be construed as a waiver of that provision or of the right to enforce it thereafter.
